These Terms of Service govern your use of the Optymyse Audio website and, once available, your purchase and use of our audio software. Optymyse Audio is a division of Optymyse Ltd, the developer and licensor of the software. By using this website or purchasing a product, you agree to these terms.
Website information
We aim to keep product descriptions, compatibility information and prices accurate. Products shown as “In development” are not yet available to order. Their features, release dates and system requirements may change before release. Displaying a planned price is not an offer to sell or a guarantee that the product will launch at a particular time.
Purchases and payment
When direct desktop sales open, Paddle will act as our authorised reseller and merchant of record. Paddle will handle payment, applicable transaction taxes, invoicing and checkout. Its Buyer Terms govern your purchase from Paddle and take priority over conflicting payment or refund provisions here. Optymyse remains responsible for the software licence and product support.
Our pricing page lists one-time plugin prices in euros (EUR), with the edition identified for each price. The final total and any applicable tax will be shown before you pay. Each purchase covers the named plugin edition; it is not a subscription. Supported formats, platforms and any activation requirements will be stated on the product page or at checkout before purchase.
Refunds and cancellation rights
Our Refund Policy forms part of these terms and explains eligibility and how to request a refund. It preserves mandatory consumer rights and the rights in Paddle's applicable terms.
Third-party marketplaces
Purchases from the App Store, the Darkglass Anagram Marketplace or another third-party store are separate transactions governed by that store's checkout and refund terms. Desktop pricing does not include a separately sold iOS or Anagram edition unless the offer expressly says so. App Store pricing varies by region.
Software licence
Unless a product-specific licence says otherwise, purchasing a plugin grants you a limited, non-exclusive, non-transferable licence to install and use it for your own personal or professional audio work. You may use audio created with the software commercially.
You may not redistribute, resell, sublicense, share, reverse engineer or attempt to extract source code or protected assets from the software, except where applicable law expressly permits this.
Compatibility and updates
Supported platforms and plugin formats are listed on each product page. You are responsible for checking compatibility before purchase. We may provide maintenance updates, fixes or feature changes, but do not promise that every product will remain compatible with every future operating system, host or hardware platform.
Intellectual property
The website, software, branding, graphics, text and other materials are owned by or licensed to Optymyse Ltd and are protected by intellectual-property laws.
All third-party product names used on this website are trademarks of their respective owners. Optymyse Ltd is not associated or affiliated with those owners. These trademarks appear solely to identify products whose tones and sounds were studied by Optymyse Ltd during sound-model development.
Acceptable use
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with its operation, or use it in violation of applicable law or another person’s rights.
Disclaimers and liability
The website and pre-release information are provided on an “as available” basis. Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that, we are not liable for indirect or consequential loss arising from use of the website or software. Your statutory consumer rights are not affected.
Changes and governing law
We may update these terms for future purchases and will post the revised version here with a new date. Publishing an update does not retrospectively reduce the rights attached to an existing purchase. These terms are governed by the laws of England and Wales. If you are a consumer, you also retain any mandatory protections and rights available under the law where you live.
